Information providers, including securities markets and exchanges that make market data available and any information processor or other entity that assists in providing such market data, have proprietary interests in the market data that they make available. You acknowledge that the market data is and shall remain the property of the respective exchange or other market on which a reported transaction took place or a reported quotation was entered. You may use this market data only for your personal, non-business use. You may not retransmit market data. You acknowledge that stock quotes displayed by Newedge USA are provided by outside vendors; Newedge USA does not guarantee the accuracy of any quote information; and you agree not to hold Newedge USA responsible for any injury associated with any trade made in reliance upon such quote information. Newedge USA and the information providers may discontinue or modify any of the market data at any time without any liability to you.

The Information Providers do not guarantee the timeliness, sequence, accuracy or completeness of any market data or other information or message that they disseminate. No Information Provider shall be liable in any way to you or to any other person for any inaccuracy, error or delay in or omission of, any such data information or message, or any loss or damage arising from or occasioned by any such inaccuracy, error, delay or omission or by reason of non-performance, or of interruption in such data, information or message, either due to any negligent act or omission by any disseminating party or due to any "force majeure" or any other cause beyond the reasonable control of the disseminating party. The Information Providers may enforce this Agreement against you by legal proceedings or other appropriate means.

Neither Hyperfeed, nor any data feed source, nor anyone else involved in creating, producing, delivering or installing the information will be liable to client or to any third party for any indirect, incidental, special or consequential damages of any kind, including lost profits, lost business and lost data arising out of use thereof or out of any breach of this agreement. Liability of Hyperfeed in any and all categories, whether arising from mistakes, omissions, interruptions, delays, errors or defects, or arising under contract, infringement, warranty, tort (including negligence), or otherwise, even if Hyperfeed has been advised of the possibility of those damages will in no event exceed, in the aggregate, one (1) month's fee applicable to that portion of the information directly affected by the mistake, omission, delay, error or defect.

All information provided by ComStock, Inc. ("ComStock") and its affiliates (the "ComStock Information") is owned by or licensed to ComStock and its affiliates and any user is permitted to store, manipulate, analyze, reformat, print and display the ComStock Information only for such user's personal use.
